Do I need a Camping and Caravan Site Licence?
Yes. To run a caravan and camping site you will need a licence from us.
Anyone stationing a caravan or mobile home on land and using it for accommodation will require planning permission both for the caravan or mobile home and for the use of the land for residential purpose or holiday purposes.There are some limited exceptions to this which covers small numbers of touring caravans (up to 5) on land for a limited period of time, where the owner of the land has a certificate from an organisation such as the caravan club.Where a site has got planning permission the owner of the site must have a caravan site license which is granted by Colchester Borough Council. The purpose of the license is to regulate the standards being maintained. The licence is also to condition the type of use for the site such as holiday purposes only.There is no fee for this licence but it will be issued subject to a set of site conditions. These are based on model conditions but will vary according to whether the site is used for permanent residential caravans, static holiday vans, touring vans or a single caravan on a site.
Conditions may be attached to a licence to cover any of the following:• restricting when caravans can be on the site for human habitation or restricting the number of caravans that can be on the site at any one time• controlling the types of caravans on the site• controlling the positioning of the caravans or regulating the use of other structures and vehicles including tents• to ensure steps are taken enhance the land, including planting/replanting bushes and trees• fire safety and fire fighting controls• to ensure that sanitary and other facilities, services and equipment are supplied and maintainedThe criteria for applying for Caravan and Camping Licence are as follows:
• The applicant must be entitled to use the land as a caravan site• A judgement also has to be made to whether the applicant is a "fit and proper" person to hold a licence• Licences will not be issued to applicants who have had a site licence revoked within three years of the current application.• The application must detail the land concerned and include any other information required by us.How much does it cost to apply?
There is no fee for a Caravan and Camping Site Licence. This will be changing soon.
How long will my application take?
We aim to have a Camping and Caravan Licence completed within 90 days.
Do I need to renew my license?
There is no need to renew the licence but if you wish to vary the licence please contact the Licensing Team.
What can I do if my application to alter a condition is unsuccessful?
Please contact us in the first instance. If you are refused an application to alter a condition you may appeal to the local Magistrates' Court within 28 days of the written notification of the refusal and a notice of appeal must also be served on Council.
What can I do if I am unhappy with conditions regarding my licence?
Please contact us in the first instance. If you wish to appeal against a condition attached to the licence you can appeal to a local Magistrates' Court. This must be made within 28 days of the licence being issued.
We may alter the conditions at any time but must give you the opportunity to make representations about the proposed changes. If you disagree with the alterations you may appeal to the Magistrates Court. This must be made within 28 days of the written notification of the alteration and a notice of appeal must be served on the Council.
What if I want to complain about a licence holder?
We would always advise that in the event of a complaint you contact the licence holder first – preferably in the form of a letter (with proof of delivery).
